This case involved a request to evict a tenant for unpaid rent. The key issue was which rules should be used for determining the rent and rent increases.

Background

A landlord filed a case against a tenant and requested the court dismiss the tenancy agreement and order the tenant to vacate a shop and pay 4732 Egyptian Pounds. The landlord said that the tenant had failed to pay the rent and the legal increase in the rent.

The court rejected the case.

The landlord appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the tenancy agreement should be dismissed and the tenant should vacate the shop and pay 4732 Egyptian Pounds.

Decision

The tenant appealed the ruling before the court of cassation and stated in her grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He stated the court had established its ruling based on Egypt Law No. 6/1997 and increased the rent accordingly although the property did not fall under the rules of rented places law.
