ECC 1859/70, 2444/70, 2447/70
Background
Some sellers sold to property for 1800000 Egyptian Pounds where the purchasers paid 1500000 Egyptian Pounds when they signed the contract and agreed to pay the remaining amount in three instalments. They two parties also agreed the buyer would give four flats to the sellers. The two parties agreed that the party who failed to commit to the contract would pay 1000000EP.
The first two sellers filed a case against the buyers and requested the court to dismiss the contract and order the buyers to pay 1000000 Egyptian Pounds because the buyer had failed to pay the instalments.
The buyers filed a case against the sellers and requested the court to order them to pay 1000000 Egyptian Pounds and to give up the flats.
The court rejected the seller's case and ruled the seller should pay 1000000 Egyptian Pounds and give up the flats.
