The original dispute involved a request for a divorce to be ordered by a woman whose husband had left her and did not provide her expenses. The appeal was rejected as the lawyer who had filed the appeal did not provide the court with an agency document which confirmed that he was the husband's legal representative.

Background

A woman filed a case against her husband and requested the court to order him to divorce her. The woman stated she married him on 14/10/1991 but he left her for a long time and refused to pay her expenses.

The court ruled that the husband should divorce the woman.

The husband appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The husband appealed the ruling before the court of cassation.

The Public Prosecution requested the court to dismiss the appeal because the lawyer who had filed the appeal did not provide the court with an agency document which confirmed that he was the husband's legal representative.
