ECC 1759/2001

This case involved a request for an eviction because of unpaid rent. Evidence from the tax department proved there had been a long standing dispute on the rent and the rent should have been valued in line with of Egypt Law No. 52/1969.

Background

A property owner filed a case before Luxor Court of First Instance against a lessee requesting the termination of a rent contract and that the property be vacated due to a delay in rent payments despite a warning. The Court of First Instance refused the claim and the plaintiff appealed before the Court of Appeal who cancelled the appealed ruling and requested the lessee to vacate the property and pay 537 Egyptian Pounds in rent.

Decision

The defendant filed an appeal in cassation on the ground that the appealed ruling had violated the law and erred in its application because evidence brought to the court by the tax department proved the existence of a conflict on the amount of the rent since 1974.
