This case involved a retired judge who was claiming for untaken holiday pay. This case provided guidance on the maximum amount of holiday pay which could be awarded in such circumstances.

Background

A former chairman of a court of appeal made a request against the Minister of Justice and requested the court to validate his right to receive holiday pay he had not used and for that to be calculated based on comprehensive salary. The chairman stated he had retired from his position on 23/05/1993 and received holiday pay at the maximum rate of three months according to Article 57 of Egypt Law No. 47/1978 without receiving bonuses and other promotion amounts.

The court stated the Law of Judicial Authority included no obligation for judges to receive the value of their holidays which they had not used and so the court should consider the case in accordance with Egypt Law No. 47/1978 which was amended by Egypt Law No. 219/1991.
