This case involved whether a judge who was working overseas deserved a monthly salary and medicine allowance.

Background

A former judicial consultant filed a request against the Minister of Justice and the Chairman of Health and Social Fund and requested the court to validate his right to receive an additional monthly salary and a medicine allowance. The consultant stated he was seconded to work abroad after his resignation but was deprived of the additional monthly salary and medicine allowance.

Decision

The court of cassation stated the constitutional court had ruled that stopping payment of the additional monthly salary for the judges who were working abroad was unconstitutional. The court stated the consultant had worked for more than 15 years in the judicial body and the Ministry of Justice had refused to pay him the additional monthly salary. The court ruled that the consultant deserved the additional monthly salary.

The court stated the constitutional court had ruled that the judges who work abroad do not deserve the medicine allowance. The court rejected the request in this regards.
