Eviction – Tenant Left Property – Tenant – Tenancy Agreement – Family members
This case involved a request for eviction and the dismissal of a tenancy agreement. The key issue was whether the original tenant had surrendered the property when he allowed his parents to live there.
Background
A landlord filed a case against a tenant and requested the court to dismiss the tenancy agreement dated on 3/01/1962 and order the tenant to vacate the flat. The landlord stated that the tenant had rented the flat from his father. The landlord said the tenant left the flat for his parents who moved to another flat later.
A second tenant requested the court to order the landlord to release a new tenancy agreement for him and stated that he was living with his grandfather in the flat.
The court rejected the two cases.
The landlord and the second defendant appealed the ruling before the court of appeal. The court ruled the tenancy agreement should be dismissed and rejected the defendant's appeal.
