Background
A former judicial consultant filed a request against the Minister of Justice and the Chairman of the Social and Health Fund and requested the court order them to pay him an additional monthly salary for the period from 01/10/1990 until the date of filing the request plus a medicine allowance from 01/10/1990 until the date of filing the request. The consultant also requested the court to order the fund to provide him health services because depriving him of these services because he had been seconded to work abroad violated the law.
Decision
The court of cassation stated that the constitutional court had ruled that Article 34 of Egypt Ministerial Decision No. 4853/1981 which stipulated that judges working abroad should not deserve an additional monthly salary was unconstitutional. The court ruled the consultant deserved this amount starting from 01/10/1990.
The court stated the constitutional court had ruled that judges who working abroad could not enjoy health services provided by the fund. The court rejected this request.
