Tenancy Agreement – Rental Relationship – Agricultural Land – Ownership of Land – Eviction – Evidence - Court
This case involved a request to evict a tenant. A company claimed it owned the land and wanted to end the tenancy. The court had been wrong not to refer the case for investigation after it was claimed a new rental relationship existed.
Background
A claimant filed a case against a company and requested the court order the company to vacate a property and dismiss a rental relationship. The claimant stated the company had rented property from the Bureau of Agrarian Reform but ownership had been transferred to him and he wanted to end the tenancy.
The company requested the court reject the claimant's case and apply the Law of Rented Places over the case.
The court rejected the company's case and ruled it should vacate the property and that the rental relationship should be dismissed.
The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
