Background

A claimant filed a request and requested the court change his position so he be classed a prosecutor from 28/06/1997 and modify his seniority level. The claimant also requested the court to add his service in the Bureau of State Affairs to the period of his service.

The Public Prosecution stated the request should be rejected because it was not filed within the deadline.

Decision

The court of cassation stated this argument was valid and that changes to seniority cannot be made unless an appointment decision is dismissed. The court stated the decision made by the claimant should be filed within the deadline of 30 days stipulated by Article 85 of Egypt Law No. 46/1972. The court stated the claimant had been appointed as a deputy prosecutor on 25/08/1997 and filed his request on 26/10/1997.

The court stated the claimant's request on the period of his service in the Bureau of State Affairs should be dismissed.
