ECC 14/66
Background
A woman filed a case against her husband and requested the court to dismiss the marriage contract. The woman stated she married the husband according to the rules of the Coptic Orthodox Church and found that he was impotent.
The court rejected the case.
The woman appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The woman appealed the ruling before the court of cassation. The court repealed the ruling and referred the case to the court of appeal.
The court stated that the medical report had concluded that the husband had no medical problem that prevented him from having sex with his wife and that the wife had failed to provide any evidence of her claims.
The court dismissed the appeal and upheld the elementary ruling.
