ECC 1495/59

This case involved a tenant who was claiming his right to live in a disputed property, which the landlord had rented to another person and refused to provide the tenant with a tenancy agreement. The court had been wrong to ignore the tenant's defence that accusations of him seizing the flat which were considered by the court had prevented him from filing his case within the legal deadline.

Background

A tenant filed a case against a landlord and requested the court to validate his right to live in a disputed flat. The tenant stated he used to live with his family in the flat but the landlord had refused to release a tenancy agreement for him. The tenant stated the landlord had rented the flat to another person.

The court rejected the case.

The court appealed the ruling before the court of appeal. The court upheld the appealed ruling.
