Sale of Property – Unpaid Amount – Inheritance – Property License
This case involved the sale of a property in which the purchaser refused to pay an outstanding amount. The key issue was whether this amount could be withheld until a property license was provided. The court had been wrong to assume there was a license for this property as the license related to another property.
Background
The heirs of a deceased man filed a case against a defendant and requested the court order him to pay 170000 Egyptian Pounds. The heirs stated their father had sold a property to the defendant for 677000 Egyptian Pounds but he had only paid 507000 Egyptian Pounds and refused to pay the remaining amount.
The court ruled the defendant should pay the heirs 170000 Egyptian Pounds.
The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
