This case involved a request for a divorce on the grounds of infidelity. The appeal documentation had not properly stipulated reasons for the appeal.

Background

A husband filed a case against his wife and requested the court to dismiss their marriage contract dated 18/09/1983. The husband stated he married the wife according to the rules of the Coptic Orthodox Church but she had cheated on him because she was sick with cancer before the marriage.

The court rejected the case.

The husband appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled that the marriage contract should be dismissed.

Decision

The wife appealed the ruling before the court of cassation and stated in her grounds of appeal that the ruling had insufficient evidence of causation because the court had established it based on unreasonable reasons.

The court stated this argument was invalid because Article 253 of the Pleadings Law stipulated that the appeal document should include the reasons behind the appeal.

The court dismissed the appeal.
