Background

An employee filed a case against a company and requested the court to validate his promotion and order the company to pay him 30000 Egyptian Pounds in compensation.

The court ruled that the employee's promotion should be validated starting from 13/12/1995 and ordered the company to pay him 200 Egyptian Pounds in compensation.

The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law. It stated promotion to Grade A positions was being made by a choice and only the company had the right to choose a suitable person for such positions.

The court stated this argument was valid.

The court repealed the ruling.
