ECC 110/2001

This case involved whether a retired employee should receive a pension from a waqf. The employee was a state employee who had worked at the authority which regulated various waqf and had no employment relationship with this particular one so was not due a pension from it.

Background

An employee filed a case against the managers of Islamic Waqf before the court requesting they pay him 314 Egyptian Pounds. The employee said that he used to work at the Waqf until his retirement.

The court ruled that the managers of the Islamic Waqf should pay the employee a monthly salary of 314 Egyptian Pounds from the rent of the Waqf.

The managers appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The managers appealed the ruling before the court of cassation and said in their grounds of appeal that the ruling had erred in the application of law because the court ruled that the employee should receive a monthly salary from the rent of Waqf though the employee did not meet the relevant conditions as he was a public servant.
