Background
A company filed a case against defendants requesting that the court order them to pay 110174.75 Egyptian Pounds in compensation for a shortage in a shipment it had imported.
The court ruled that the defendants pay the company 152342.090 Egyptian Pounds plus legal interest at 5%.
The defendants appealed and the appeal court upheld the ruling.
The defendants appealed by cassation.
Decision
Before the cassation court the defendants argued that the ruling had violated the law as the court had ruled that the first defendant pay compensation as legal representative of the ship's owner, however it had denied this argument and the company had failed to provide the court with evidence to substantiate this claim.
The court held that this argument was valid and repealed the ruling.
