Background
A claimant filed a case against a company requesting that the court order the company to pay him 100000 Egyptian Pounds in compensation and his notice-period salary. The claimant stated that he used to work with the company but had been deprived from working based on him sending his resignation letter by fax but he did not.
The court ruled that the company pay the claimant 5000 Egyptian Pounds in compensation plus a month's salary.
The claimant and the company appealed and the appeal court rejected the appeal made by the company and ruled that the company pay the claimant 10000 Egyptian Pounds in addition to his notice-period salary.
The company appealed by cassation.
Decision
Before the cassation court, the company argued that the ruling had erred in the application of law and had insufficient evidence of causation as the court had established its ruling based on the claimant denying the resignation letter, but the company had requested that the court refer the case for investigation to prove its claims but it did not.
