Background
A landlord filed a case against a tenant requesting that the court order the tenant to vacate a rented property as he had failed to pay rent differences despite receiving notice.
The court ruled that the tenant vacate the rented property.
The tenant appealed and the appeal court upheld the ruling.
The tenant appealed by cassation and the cassation court repealed the ruling and referred the case to the court of appeal. The appeal court abandoned the ruling and rejected the case.
The landlord appealed by cassation.
Decision
Before the cassation court, the landlord argued that the ruling had erred in the application of law as the court had rejected the case based on the payment order including the entire rent instead of rental instalments under Article 22 of Egypt Law No. 49/1977, however this article should only apply to properties which fall under the estimation of rent committees.
