Background
Claimants filed a case against a defendant requesting that the court order the defendant to give up a tenancy agreement and vacate a rented property. The claimants stated that the defendant had rented the shop from their father. Their father had then notified the claimants that he was going to sell the shop for 40000 Egyptian Pounds and they could pay half of this value if they wanted to remain in the shop. The claimants stated that they had deposited half of this value in the court's treasury but the defendant had failed to commit to his pledge.
The court rejected the case.
The claimants appealed and the appeal court ruled that the tenancy agreement be dismissed and the defendant should vacate the shop.
The defendant appealed by cassation.
