ECC 88/2000

This case involved a request by a husband for a divorce. The court had been wrong to apply the rules for the Orthodox Coptic when the spouses were members of the evangelical church

Background

A husband filed a case against his wife before the personal affairs court requesting a divorce from his wife. The husband said that the wife used to insult him and filed many cases against him before the courts.

The court ruled that the wife should be divorced from her husband.

The wife appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The wife appealed the ruling before the court of cassation and said in her grounds of appeal that the ruling had erred in the application of law because the court established its ruling based on Article 57 of the Appendix of Personal Affairs of Orthodox Coptic though the court should have applied Article 18 of the Appendix of Personal Affairs of the Evangelical Church.
