Landlord – Tenant – Tenancy Agreement – Rent – Additional Amount – Eviction
This case involved a request to evict a tenant who had not paid rent and an additional amount which was due. Although the requirement to pay the additional amount was in the tenancy agreement there was a question over whether it was legal in this situation. The court should have taken a decision on this point before ordering the eviction.
Background
A landlord filed a case before the Court of First Instance against a tenant requesting him to vacate a property and hand it over because he had failed to pay the rent and an additional amount determined by the law.
The Court issued a ruling that requested the defendant to vacate the property and hand it over. The defendant filed an appeal and the court of appeal confirmed the Court of First Instance's ruling.
