ECC 713/2000

This case involved a request to return to the arbitrators because of a forged document. An appeal in such a case could only be made by those who requested the return.

Background

A claimant filed a case against arbitrators before the court requesting the arbitrators to return to an arbitration contract dated on 24/05/1990 that he signed with a company. The claimant said that the arbitrators did not comply with the conditions of the contract and they did not suspend the process of arbitration when he appealed against a fabricated document provided by the company.

The court ruled that the arbitrators should return to the contract.

The arbitrators appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case and ruled the claimant should pay a fine of 100 Egyptian Pounds.

Decision

The claimant appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had erred in the application of law and that the court had made a mistake by accepting the appeal made by the arbitrators because the appeal should only be accepted from the party who requested the return of the arbitrators.
