ECC 6623/2000, 6649/2000

This case involved the right of a government department to transfer some employees to new positions following company mergers. The mergers had led to a labour surplus and as the positions were the same and had the same salary this was valid.

Background

The claimants filed a case against the first defendant and other defendants before the labour court requesting the cessation of the implementation two decisions No. 19 and No. 267/1985. The claimants requested the dismissal of the decisions and payment of compensation.

The court ruled that the decisions should be dismissed and the defendants from the eighth to eleventh should pay the claimants 51 Egyptian Pounds each.

The first defendant and other defendants appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The first defendant appealed the ruling before the court of cassation through Appeal No. 6623/63. The other defendants appealed the ruling before the court of cassation through Appeal No. 6649/63.
