Background
A company filed a case against a company before the commercial court requesting the company pay an amount of money and interest in addition to storage fees.
The court ruled that the company should pay 49728 Egyptian Pounds in addition to 4% legal interest.
The two companies appealed the ruling before the court of appeal. The court dismissed the two appeals and upheld the appealed ruling.
Decision
The company appealed the ruling before the court of cassation and said in its grounds of appeal that the ruling had erred in the application of law because the court calculated the storage fees starting from 26/07/1991 instead of 18/07/1991, namely the date in which the exemption period finished under Article 1 of Egypt Decision No. 79/1991.
The court said that this argument was valid because the case file revealed that the date the ship was unloaded started on 11/07/1991 and the calculation of storage fees should have started seven days after this date.
The court repealed the ruling.
