ECC 6375/2000
Background
A claimant filed a case against defendants before the partial court requesting the validation of their ownership of reserved chattels and dismissal of the reservation.
The court ruled that the ownership of the claimant of the reserved chattels should be validated and that the reservation should be dismissed.
The first and second defendants appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case.
Decision
The claimant appealed the ruling before the court of cassation and said in her grounds of appeal that the ruling had violated the law and the right of defence because the court ignored the documents she provided to prove her ownership of the chattels and dismissed her request to refer the case to investigation.
