This case involved a claim by an employee who had been receiving social insurance for permanent disability which had then be changed to social insurance for partial disability. The National Organisation had a right to re-assess disability levels in the first few years but the court ruled this employee's disability should be classed as a permanent one.
Background
An employee filed a case against the National Organization for Social Insurance and the General Authority for Social Insurance requesting the payment of his salary starting from 08/12/1987. The employee said that the used to receive a salary for permanent disability and that the first defendant then started to pay him a salary for partial disability although the medical commission confirmed that he had a permanent disability.
The court ruled that the employee deserved a salary for permanent disability.
The National Organization for Social Insurance appealed the ruling before the court of appeal.
The court upheld the appealed ruling.
