ECC 553/2000

A case involved the validity of a husband's appeal after his wife was granted a divorce.

Background

A woman filed a case against her husband requesting that the court grant her a divorce. The woman stated that her husband had remarried and refused to pay her living expenses.

The court granted the woman a divorce.

The husband appealed and the appeal court upheld the ruling.

The husband appealed by cassation.

Decision

Before the cassation court, the husband argued that the ruling had insufficient evidence of causation as the court had not considered the documents provided by the parties.

The court stated that this argument was invalid as Article 253 of the Egypt Pleadings Law stipulates that appeal documents should include the reasons for an appeal. The court held that the husband's appeal document did not include such reasons.

The court therefore dismissed the appeal.
