Landlord – Tenant – Eviction – Death of Tenant – Children – Guardianship – Tenancy Agreement
This case involved the eviction from a rented property after the original tenant had passed the tenancy on to his daughter who had died. The original tenant's grandchildren were still living in the property and they were their guardian. Tenancy agreements were treated as a familial agreement and any member of the family living in a property could intervene in a case.
Background
A landlord filed a case against tenants before the court requesting the tenants to vacate a disputed property. The landlord said that the first tenant had rented the property and then he gave it up to his daughter and a new tenancy agreement was released for her. The landlord said that the daughter had died and no one was living with her at the time.
The court ruled that the tenants should vacate the property.
The tenants appealed the ruling before the court of appeal. The court upheld the appealed ruling.
