ECC 4713/2000

This case involved a claim for the validation of ownership of some land. An appeal was rejected as some of the defendants had not paid the guarantee. This was an indivisible subject all defendants should be deemed as one party.

Background

Some claimants filed a case against defendants before the court requesting the validation of their ownership of some disputed land. The claimants said that their father owned the land as a result of seizure for a long time.

The claimants appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the claimants' ownership of the land should be validated.

The defendants appealed the ruling before the court of cassation.

Decision

The Office of Public Prosecution said that the appeal made by the second and third defendants should be dismissed because they had failed to pay the value of a guarantee before they filed their appeals. The office said that the ruling should be repealed.
