This case involved the transfer of the obligation to pay employees' salary and bonuses as a rent of a company leasing a hotel to another company.
Background
Some employees filed a case against a company before the court of first instance requesting the company to pay their dues and bonuses the employees had received in 1988. The employees then amended their requests and requested the dismissal of secondment decisions which had been issued by the company.
The court ruled that the secondment decisions should be dismissed.
The first company to which the employees were seconded appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the two companies should pay the employees their dues.
