ECC 438/2000

This case involved a claim by a wife for alimony. The alimony amount should be based on the circumstances of the divorce and the husband's financial position at the time of the divorce.

Background

A wife filed a case against her husband before the plenary court requesting her husband pay her alimony. The wife said that the husband had divorced her without justifications.

The court ruled that the husband should pay the wife 18000 Egyptian Pounds in alimony.

The husband appealed the ruling before the court of appeal. The court ruled that the value of the alimony should be decreased to 12000 Egyptian Pounds.

Decision

The husband appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had violated the law and had insufficient evidence of causation. He had maintained before the court that his financial status had changed and the alimony assessment should have been made in accordance with his new financial status.
