Background
A landlord filed a case against a tenant before the court of first instance requesting the dismissal of a tenancy agreement dated 21/11/1987 and the vacation of a flat. The landlord said that the tenant had failed to pay the rent.
The landlord filed another case against the tenant before the first instance court requesting the tenant vacate the flat. The landlord said that the tenant had failed to pay the rent for a different period mentioned in the first case.
The court dismissed the second case and ruled that the tenancy agreement should be dismissed and that the tenant should vacate the flat.
The tenant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
