ECC 397/69, 410/69

This case involved a claim for commission by an individual who have been instructed to act as an agent and find a tenant for a property. The court had been wrong to demand the commission be paid when the tenancy agreement had been signed after the agency agreement had ended.

Background

A claimant filed a case against a defendant and requested the court order him to pay her $50000 and legal interest. The claimant stated she had agreed with the defendant to find a tenant for his property for five years in exchange for receiving four-months' rent. The claimant stated she had found a tenant but the defendant had refused to fulfil his obligation according to the contract dated on 12/06/1992.

The court ruled that the defendant should pay the claimant $50000.

The defendant appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the defendant should pay the claimant $10000.

The defendant and the claimant appealed the ruling before the court of cassation (Appeal No. 397/69) and (Appeal No. 410/69).
