ECC 3563/2000

This case involved a request for a declaration of insolvency against a judicial guardian by an individual who had tried to execute a legal judgment but said there was insufficient money to pay the debt. The claimant was required to provide evidence that the association had been unable to pay its debts when they fell due.

Background

An individual filed a claim before the Court of Cassation in 1997 against another in his capacity as the judicial guaridan of the law association and in his person capacity and against a number of other individuals requesting that declaration of the judicial guardian's insolvency. The person claimed that he should be paid his salary for a number of months from the association and that there was an existing ruling requesting the assoication to pay individual 2247 Egyptian Pounds a month for a number of months in 1997. The individual had tried to exeucte the ruling against the assocation but found out that the assocation's money in banks was insufficient to settle the debt.
