ECC 3410/2000

This case involved a claim for compensation against an insurance company by the heirs of a man killed in a road traffic accident. The civil case should have been stayed as the criminal case against the driver was not yet final.

Background

Seven heirs filed a claim against an insurance company and another person requesting they jointly pay 90,000 Egyptian Pounds in compensation for financial and moral damages they had suffered as a result of the death of the person who they had inherited from. The death was a result of a car accident where the car was insured by the insurance company. The driver was charged by the court of first instance and requested to pay compensation. Both parties appealed the ruling before the court of appeal which issued a ruling dismissing the appeal submitted by the insurance company. As for the appeal submitted by the seven heirs the court of appeal ruled that the compensation should be increased.
