This case involved a claim by a patient for compensation following medical procedures. The key issue in this case was that no evidence had been provided that the procedures had failed. In addition, there was a difference of medical opinion on the matter so the doctor should not be blamed for following one of the approaches.

Background

A patient filed a case before the court of first instance against a doctor and the legal representative of a hospital requesting the referral of a claim to the competent technical body and that they jointly pay her 250000 Egyptian Pounds plus interest in compensation for the damages she had suffered due to medical mistakes by the doctor in the hospital. The patient claimed that professional and technical standards were not followed in the two procedures she had. The forensic medicine department provided two reports on the case but the court of first instance dismissed the case.
