ECC 289/69

This case involved a request for a property to be vacated because of unpaid rent. The court had been wrong not to check if the lessor had presented the tenant with the lease contract. It was also not detailed in the contract that eviction would happen if the rent was not paid.

Background

A lessor filed a case before the Court of First Instance against a lessee requesting him to vacate a property and hand it over because he had failed to pay the rent.

The Court rejected the case. The plaintiff filed an appeal and the court of appeal dismissed the Court of First Instance ruling and requested the defendant to vacate the property and hand it over.
