This case involved a claim by some heirs that the tenants of a property which had belonged to their dead mother had seized all the profits for those properties. The court had been wrong to base its judgment on sworn statements which only involved the status of part of the property.
Background
Two heirs filed a claim requesting some tenants jointly pay them 3000 Egyptian Pounds for the profits made from their inheritance, two properties, left by their late mother because the tenant had taken all the profits from the properties. The court appointed an expert and issued a ruling requesting the tenants to jointly pay 2392 Egyptian Pounds.
The tenants appealed the ruling before the court of appeal. The heirs gave a sworn testimony that they did not take any profits from the properties and submitted tenancy agreements to the court. The court issued a ruling upholding the appealed ruling.
