This case involved whether a tenancy agreement should be terminated and a property vacated when the tenant's residency visa expired. The tenant's wife and children were Egyptian nationals and the tenancy should be extended to cover them if they did not leave the country.

Background

A landlord filed a case against a tenant before the court requesting the termination of a tenancy agreement and eviction from the rented property. The landlord said that the residence permit of the tenant in Egypt had terminated.

The court ruled that the tenancy agreement should be dismissed and that the tenant should vacate the property.

The tenant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The tenant appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation because he had maintained before the court that his Egyptian wife and his sons were still living in the property and they left the property temporarily because an eviction ruling was issued against them but this ruling was dismissed after that.
