Background
A claimant filed a case against defendants before the court of first instance requesting the defendants to pay him an amount of money and interest. The claimant said that he had imported a shipment of timber but the customs department considered the shipment above the licenced quantity and fined him.
The court dismissed the case.
The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the defendants should pay the claimant 17119.079 Egyptian Pounds and 5% interest.
Decision
The defendants appealed the ruling before the court of cassation and said in their grounds of appeal that the ruling had erred in the application of law and that the claimant had imported a quantity of timber above the licensed quantity in violation to the export regulations and thus should pay compensation under Article 1 and 15 of Egypt Law No. 118/1975.
