A case involved whether heirs were due inherited compensation for the death of their father in a car accident.

Background

Heirs of a deceased man filed a case against two defendants requesting that the court order the defendants to pay compensation for the death of their father in a car accident. The heirs stated that the car was owned by the second defendant and that the first defendant was the driver.

The defendants added the insurance company to the case and requested that the court order the insurance company to pay the value of compensation with the other defendants.

The court ruled that the defendants and the insurance company pay the heirs 15000 Egyptian Pounds.

The heirs and the insurance company appealed and the appeal court upheld the ruling.

The insurance company appealed by cassation.

Decision

Before the cassation court, the insurance company argued that the ruling had erred in the application of law and contradicted material documentary evidence as the court had ordered it to pay inherited compensation but the heirs had requested the payment of moral and material compensation.
