ECC 166/69

This case involved a request for the termination of a lease agreement, eviction and the payment of late rent. The court had been wrong to rule on the basis of the rent law when this was a furnished property and the dispute should have been subject to the civil code.

Background

A lessor filed a case before the Court of First Instance against a lessee requesting the termination of a lease agreement and the vacation of the property and that late rent be paid.

The Court issued a ruling that terminated the lease agreement and requested the defendant to vacate the property and hand it over plus pay the amount of rent for the requested period.

The defendant filed an appeal and the court of appeal amended the appealed ruling and compelled the defendant to pay 912,600 Egyptian Pounds.
