ECC 1443/2000
Background
A company filed a case against a shipping company before the court requesting the shipping company to pay 20963.2 Egyptian Pounds and 5% interest as compensation for the shortage in imported shipment.
The court ruled that the shipping company should pay the company 13746.135 Egyptian Pounds and 5% interest.
The shipping company appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case.
Decision
The company appealed the ruling before the court of cassation and said in its grounds of appeal that the ruling had erred in the application of law because the court had dismissed the case based on the statute of limitations though the company sent a notification to the shipping company requesting the value of compensation.
