Employee’s Rights – Unfair Dismissal – Termination of Employment – Trial Period – Benefits – Resignation
This case involved a claim by an employee for unfair dismissal. It was possible to set multiple trial periods on a particular employee if they were for different jobs and fairly dismiss during them. As the employee had resigned they were not entitled to the benefits.
Background
An employer filed a case before the labour office against a company requesting compensation because he had been arbitrarily dismissed.
The court issued a ruling cancelling the dismissal, compelled the company to pay the salary due to the plaintiff and referred the case to the Court of First Instance. The plaintiff requested a compensation of 25000 Egyptian Pounds.
The Court of First Instance ruled that the company should pay the employer 5000 Egyptian Pounds in compensation for dismissal and 550 Egyptian Pounds for the value of profits on bonds.
Each party filed an appeal before the Court of Appeal who rejected both appeals and confirmed the Court of First Instance ruling.
