ECC 125/2000

This case involved a woman who had requested a divorce on the grounds of domestic abuse. Key issues included whether it was legitimate for the woman's witnesses to include her uncle and the fact that the court did not have to send the case for investigation as the husband had been given but not taken the opportunity to have his own witnesses.

Background

A wife filed a claim against her husband requesting a final divorce claiming that he had physically and verbally abused her. The wife also filed another claim saying he had violated an injunction as he hit her and threatened to kill her. The court grouped both claims and issued a ruling divorcing her from her husband. The court appealed the ruling before the court of appeal which upheld the ruling.
