ECC 124/2000

This case involved a request by a husband for the dismissal of a divorce ruling. There had been an earlier ruling which the husband stated he had not been notified of but as he had failed to appeal that ruling he could not take a new case on the subject.

Decision

The husband appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. It was said that he was not informed of the proceedings of the previous case. The husband also said that the ruling did not include the names of the judges and the elements of damage that had resulted in the divorce.
