ECC 101/2000

Background

A judge requested the payment of overtime starting from the date he had started working in the non-judicial field. He stated said that he was not informed by the referral decision issued by the Minister of Justice within 48 hours of its issue.

The representative of the government requested the dismissal of the judge's request. The representative requested the judge to pay back the basic salary for the period of non-judicial work.

Decision

The office said that the court had no mandate to consider the request made by the representative of government and that the court of cassation was the responsible entity for considering such requests under Article 46 of the Law of Judicial Authority.
