ECC 568/1999

The original dispute involved compensation for injury in a road traffic accident against the company which owned the car and the company which insured it. The case by the company which owned the car against the insurance company should have been dismissed as it was outside the statute of limitations.

Background

A claimant filed a case against three defendants before the court of first instance requesting the first two defendants pay him 25000 Egyptian Pounds as compensation for damage. The claimant said that he was injured in a car accident and the car was owned by the second company and insured by the first company. The claimant said that a criminal ruling was issued against the driver (the third defendant).

The company filed a case against the insurance company before the court requesting the insurance company to pay the compensation.

The court ruled that the two companies should pay the compensation. The court ruled that the insurance company should pay the second company the compensation.

The claimants and the defendants appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision
