This case involved a claim for compensation against an insurance company after a man had died following a car accident. As the man died ten months after the accident the court should have investigated if there was a causal relationship between his death and the accident.
Background
The heirs of a deceased man filed a case against an insurance company before the first instance court requesting the company to pay them compensation of 60000 Egyptian for damage. The heirs said that their father had died in a car accident and the car was insured by the company. The heirs said that a criminal ruling had been issued against the driver.
The court ruled that the insurance company should pay the heirs 11000 Egyptian Pounds.
The insurance company and the heirs appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.
